Release, Waiver and Assumption of Risk

Fit Mama class (the “Program”) is an outdoor fitness program offered by a qualified and certified instructor (the “Instructor”).  I understand that for the instructor to accept my application to participate in the Program, I must agree to be bound by this Release, Waiver and Assumption of Risk.

 I understand that the Program involves strenuous physical activity, including muscle strength, endurance training, cardiovascular conditioning and other physical activity.  I understand that my enrolment in the Program is entirely voluntary and at my own risk.

•  I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which could prevent or limit my participation.

• I hereby confirm that I have a known disability or condition that limits my participation and I accept full responsibility for excusing myself from activity beyond my capabilities.

I understand and acknowledge that as a participant, I will be engaging in activities that involve risk of serious injury.  Such injuries may arise from, but are not limited to, the actions, inactions or negligence of the Instructor; other participants; the conditions of the premises or equipment used; the weather; or my own physical condition.  The medical conditions and injuries I may develop or suffer include, but are not limited to, heart attack; muscle strains, pulls and tears; broken bones; shin splints; heat prostration; injuries to knees, feet, back or other joints; other illness or soreness; and death. 

I take full and complete responsibility for the safety and welfare of my child[ren] who may be present during any part of the Program.

I waive any and all claims I may now or in the future have against, and release from all liability and agree not to sue the instructor for any personal injury; death and property damages, expenses or loss sustained by me as a result of my participation in the Program due to any cause whatsoever, including, without limitation, negligence or breach of statutory duty on the part of the Instructor.  Further, I agree to fully indemnify and hold harmless the Instructor from and against any claims for personal injury, death and property damages, expenses or loss caused by me as a result of my participation in the Program.  I acknowledge and agree that the forgoing paragraph is binding upon my personal representatives, heirs and assigns.

By signing this form, I declare that I am at least 18 years of age, and I have read, understood and agree to the contents of this Release, Waiver and Assumption of Risk in its entirety.
